TERMS AND CONDITIONS - DEFINITIONS
1. The ‘Hire Company’ is Friday Event.2. The ‘Client”, “hiree” or “hirer” refers to any individual, firm, or corporation hiring equipment or appointing services from the ‘Hire Campany’.
3. The ‘Equipment’ refers to all props, flowers, lighting and hire items supplied to the ‘Client’.
4. The ‘Event date’ is the day of the birthday, wedding or event supplied by the client to the hire company.
5. Mere Bailee means having control or possession of something without having any ownership or interest in it.
6. Lein refers to the right to hold another’s property as security for a debt owed.
7. Indemnity is the security or protection against a loss or other financial burden.
TERMS AND CONDITIONS OF HIRE
1. CONFIRMATION & CANCELLATION
1.1 By confirming your booking, you are agreeing to these conditions.
1.2 An additional Security bond is required in addition to the cost of equipment. The security bond will be refunded after the hire; less any incidentals or damage.
1.3 Photo ID must be presented on receipt of hire.
1.4 Refund requests made with less than 14 days notice prior to the event date will not be eligible for a refund. Similarly, if you fail to attend the event without prior notice, the refund request will not be accepted.
1.5 Booking is not transferable.
1.6 The Hirer may request to reduce or add to the order of Hire items up to 14 days before the delivery date.
1.7 Friday Events reserves the right to cancel your booking if items are no longer available due to a change of date
1.8 Friday Events reserves the right to cancel your booking due to (but are not limited to); weather conditions, natural disasters, pandemics, acts of God and acts of terrorism
2. PAYMENT
2.1 Full payment is required prior to delivery, or on collection of the equipment.
2.2 A refundable Bond is to be paid when our hire equipment is being picked up or dropped off. The bond amount will be determined by the value of the equipment hired in your booking. The bond is fully refunded back to the client after the completion of the booking, provided no damage has been made to any of our hire equipment.
2.3 Should the hire equipment be returned stained or dirty, requiring professional cleaning (or dry cleaning for cushion seats), cleaning and painting expenses will be deducted from the bond for these expenses. Should the hire equipment be lost, stolen or returned damaged, the bond money will be retained towards the repair or replacement of the hire equipment.
2.4 Credit Card Details may be kept on file to finalise any outstanding payments after the hire. When hiring equipment, you agree that any outstanding charges will be deducted from your Credit Card.
3. DAMAGE TO PROPERTY OR LOSS OF PROPERTY
3.1 The hirer must notify Friday Events if any items are lost or damaged. The client will take full responsibility for any lost property or property that is not returned and will pay incurred costs.
3.2 The client is responsible for the conduct of all guests and will take full responsibility for any damage to property caused by the client or guests or members of the public and will pay incurred costs or cover any loss of business.
3.3 Cleaning and fixing fees will be charged if equipment items are returned in an unreasonable condition. Any unfixable damages on items will be charged for the cost of replacement.
4. DELIVERY, PICK UP, INSTALLATION & PACK DOWN
4.1 Delivery pick-up, installation & pack-down charges are not included in our hire prices.
4.2 Delivery charges quoted are based on a non-specific time between 8:00am – 4:30pm, unless stated otherwise.
4.3 A surcharge may apply for specific delivery times.
4.4 Hirer is responsible for having someone available to accept the delivery and upon collection.
4.5 Hirer must provide safe access to and from the site. As well as advise of unusual delivery conditions this includes but is not limited to dangerous dogs and steep driveways.
4.6 All care will be taken, but Friday Events and its employees are not responsible for any damages to property in the course of delivery installation, pack down or pick up of our equipment.
4.7 Items are not to be removed from the delivered address without written consent from Friday Events
4.8 All items must be left in an easily accessible position at the completion of the hire. Hirer must pack the items in their respective packaging at the end of the hire period in a complete, clean and dry state.
5. DELIVERY, PICK UP, INSTALLATION & PACK DOWN CONTINUED
5.1 Failed delivery or collection attempts will be charged for.
5.2 All deliveries and pick-ups are to the ground floor only unless otherwise stated.
5.3 Additional charges may apply where the delivery of equipment is more than 25 metres away from where our vehicle can park.
5.4 Friday Events count and decision as to the condition of the goods prior to dispatch and on return shall be final.
6. USE OF EQUIPMENT
6.1 The hirer acknowledges that they have received adequate instruction on the correct use of equipment which includes verbal or written instruction. The hirer may phone to obtain further instruction.
6.2 The hirer does not hold Friday Events responsible for any injury caused to themselves or others while setting up, packing down or moving any items. Furthermore, The hirer does not hold Friday Events responsible for any injury caused to themselves or others resulting from the incorrect or negligent use of equipment
6.3 The hirer does not hold Friday Events responsible for death or loss of income caused to the client, any third parties or properties due to the hire of equipment or provided services by the hiring company.
6.4 Equipment must be used for its intended purpose.
6.5 Claims of missing or faulty items after the hire period has ended will not be considered and a refund will not be provided.
6.6 Equipment hire is for time out of the warehouse, charged at a minimum of 1 day, whether the equipment is used or not.
6.7 Hiree is permitted to decorate hire items, however, the use of permanent decoration or any decorations that may cause damage to the hire item is not permitted to be used.
6.8 Friday Events do not take any responsibility for any personal items. This included any items Friday Events have been asked to set up and/or dismantle on behalf of the hiree.
6.9 Hire items which have been substituted or removed due to wet and/or windy weather conditions which are circumstances beyond our control, will not be reimbursed back to the Hiree.
6.10 Any damages caused by other Suppliers/Vendors to Friday Events items will be the full responsibility of the Hiree.
6.11 Dried flowers and paper items (plinths and lanterns) are not to be used outdoors in wet weather or high winds. Any water damage will forfeit the bond in place. Do not place on damp surfaces including but not limited to grass and dirt.
6.12 Friday Events reserve the right to make amendments to décor and furniture items due to changes in weather or any other circumstances that arise on the hire date. This includes substituting or removing items.
6.13 Friday Events reserves the right to replace hire items with a suitable substitute in the event of unavailability or if we believe the item originally designated for hire is deemed unfit.
7 RETENTION OF TITLE
7.1 The Hirer acknowledges that is a mere bailee of the items and agrees that: (a) the hirer has no right or claim to any interest in the items; (b) the hirer cannot claim any lien over the items; (c) the hirer will not create any third party interest in the items except as may be authorized by Friday Events; (d) title to and in the items will remain with the Friday Events at all times and even if the items are intermingled, attached to or become part of other items; and; (e) any accessory or item which accedes to any of the items by any act of the hirer or another person becomes and remains the property of Friday Events.
8 INDEMNITY
8.1 Hirer agrees to defend, indemnify, assume liability for and hold Friday Events harmless from any and all claims, demands, damages, losses, suits, proceedings, penalties, expenses or other liabilities including attorney fees and court costs, arising out of or resulting from the incorrect or negligent use of equipment
9 INSURANCE
9.1 The hirer is responsible for maintaining all appropriate policies of insurance, covering liability, property and casualty insurances in amounts necessary to fully protect Friday Events against all claims, loss or damage. The hirer is responsible for any injury that may occur to persons over the hire period arising out of or resulting from the incorrect or negligent use of equipment
10 RIGHT OF ENTRY
9.1 The hirer gives Friday Events the right to enter any premises where equipment is stored, or believed by Friday Events to be located, for the purpose of examining and testing the equipment; or where the contract is concluded or the hirer is in breach of the contract, remove the equipment from the premises.
11 SEVERABILITY
10.1 If any provision of this contract is held to be unenforceable, such invalidity or unenforceability will be deemed eliminated or modified to an extent which in the court’s opinion is necessary to make the remainder of the provision and this contract enforceable.
